These Terms & Conditions govern access to and use of the Khwantum Rides website, mobile applications and mobility services. By creating an account, requesting or accepting a booking, using a Khwantum Rides service, or otherwise using the platform, you agree to these Terms to the extent permitted by applicable law.
1. Definitions
“Khwantum Rides”, “we”, “us” or “our” means the Khwantum Rides business entity identified in section 22. “Platform” means the Khwantum Rides website, rider app, driver app, fleet-owner tools, queue-marshal tools and related technology. “User” means any rider, driver, fleet owner, operator, marshal, website visitor or other authorised user of the Platform.
2. Eligibility and accounts
You must provide accurate information, use the Platform lawfully, and protect your login credentials, OTPs and access codes. You are responsible for activity performed through your account where that activity results from your failure to keep credentials reasonably secure.
Khwantum Rides may suspend, restrict or close an account where reasonably necessary for safety, fraud prevention, security, non-payment, repeated misuse, breach of these Terms, or compliance with law, subject to applicable consumer rights.
3. Nature of the Platform
Khwantum Rides provides technology and operational tools that connect riders and delivery customers with participating drivers, vehicles, fleet owners and, for City-to-City operations, taxi-rank queue processes. The exact contracting and operational arrangement may depend on the service, fleet and applicable transport-law requirements.
No provision in these Terms excludes any right or remedy that cannot lawfully be excluded under the Consumer Protection Act or other applicable South African law.
4. Service-specific rules
4.1 Sedan
Sedan is a private point-to-point ride service. Availability and final trip cost may depend on route, distance, time, demand, permitted waiting, tolls or other pricing factors shown in the app.
4.2 Mini Bus
Mini Bus is shared open-pickup transport. Riders may join while seats remain available, up to the registered capacity shown in the app, with a current Khwantum Rides rider-facing maximum of 16 seats. When capacity is full, the vehicle may become unavailable to additional riders until seats become available.
4.3 City to City
City-to-City is planned intercity transport and is not an instant private ride. Bookings must ordinarily be made at least 5 hours before departure. The route fare is fixed for the selected route. Taxi-rank pickup carries no pickup charge, while a pickup-point option may include an additional charge.
Departure times and queue/loading status may be set or updated by authorised taxi-rank queue personnel. For same-day operations, only the vehicle currently authorised to load may be presented as available for booking, subject to the Platform's operational rules. Future-date bookings may be offered where available.
4.4 Delivery
Delivery services may include Moving Only, Furniture and Business Stock using supported Bakkie or Mini Truck vehicles. A customer must provide accurate pickup, drop-off and delivery details and must not request transport of unlawful, dangerous, prohibited or inadequately packaged items. Instant and scheduled delivery may be offered depending on availability.
5. Booking confirmation
A request is not necessarily a confirmed booking until the Platform shows confirmation and, where electronic prepayment is required, the applicable payment has been successfully verified. A booking may fail or be cancelled if required information is missing, payment cannot be verified, no suitable vehicle is available, the request is unlawful or unsafe, or an operational disruption prevents performance.
6. Pricing and payment
Prices are displayed in South African Rand (ZAR) unless expressly stated otherwise. The Platform will show the applicable fare, fixed fare or estimate available before confirmation. The final amount may differ from an estimate when the booking legitimately changes, for example because of route changes, additional authorised stops, waiting time, tolls or delivery requirements.

7. Cancellations, no-shows and refunds
Cancellation rights, cancellation charges, no-show treatment and refund eligibility depend on the service and the timing/circumstances of cancellation. They are set out in our Refund & Cancellation Policy, which forms part of these Terms.
8. Rider and customer responsibilities
- Provide accurate pickup, destination, contact and booking information.
- Be ready at the agreed pickup point within a reasonable time.
- Treat drivers, passengers, fleet staff and taxi-rank personnel respectfully.
- Do not use the Platform for unlawful, abusive, fraudulent, dangerous or harassing conduct.
- Do not intentionally damage vehicles or property.
- Follow reasonable safety instructions from authorised personnel.
- For shared transport, respect other passengers and capacity rules.
9. Driver, fleet-owner and operational responsibilities
Drivers and fleet owners must maintain the licences, permissions, vehicle roadworthiness, insurance, registrations and other legal or operational requirements applicable to them. Drivers must use their assigned account and vehicle information and must not share restricted access credentials.
City-to-City queue operations must follow the authorised route/rank queue process and marshal-controlled loading/departure rules where applicable.
10. Safety and emergencies
Khwantum Rides may provide safety features, identity and vehicle records, trip status information and support channels, but the Platform is not an emergency service. In an emergency, users should contact the appropriate South African emergency service or law-enforcement authority directly.
11. Location and trip information
Some services require precise or approximate location data to identify pickup points, destinations, nearby vehicles, routes, driver progress and trip status. Location data will be handled in accordance with our Privacy Policy.
12. Communications and notices
Khwantum Rides may send transactional messages relating to OTPs, bookings, driver arrival, trip status, queue status, delays, payment status, safety notices and account security. Marketing communications will be handled in accordance with applicable consent and opt-out requirements.
13. Prohibited use
You may not attempt to hack, scrape, reverse engineer, overload, disrupt, bypass security, manipulate pricing or payment status, create fraudulent bookings, impersonate another person, misuse personal information, or interfere with the proper operation of the Platform.
14. Intellectual property
The Khwantum Rides name, logos, software, designs, text, graphics, databases and other Platform content are owned by or licensed to Khwantum Rides and are protected by applicable intellectual-property law. No rights are transferred to users except the limited right to use the Platform for its intended purpose.
15. Third-party services
The Platform may rely on third-party services such as payment processors, mapping/location providers, cloud infrastructure, SMS/OTP providers, app stores and analytics or support tools. Those services may have their own terms and privacy practices.
16. Platform availability
Khwantum Rides aims to keep the Platform available and accurate but does not guarantee uninterrupted availability. Service can be affected by connectivity, device limitations, map/provider errors, maintenance, strikes, road closures, weather, taxi-rank operations, vehicle breakdowns, load availability, public-safety incidents or other circumstances outside reasonable control.
17. Liability
Nothing in these Terms limits liability or consumer rights where South African law does not permit that limitation. Subject to that rule, each party is responsible for losses that are reasonably attributable to its own unlawful conduct, breach, negligence or misconduct. Khwantum Rides is not responsible for indirect or consequential loss where such exclusion is lawful and fair in the circumstances.
18. Complaints and disputes
Users should first contact Khwantum Rides with the relevant booking reference and a description of the issue so the matter can be investigated. Nothing prevents a consumer from approaching an applicable regulator, consumer body, court or other lawful dispute-resolution forum.
19. Privacy
Personal information is processed as described in our Privacy Policy. By using services that require location, identity, payment or trip data, you acknowledge that such information may be processed where necessary to provide the service, satisfy legal obligations, protect safety or pursue another lawful basis.
20. Changes to these Terms
We may update these Terms to reflect changes in the Platform, law, payment providers or operating model. Material changes should be communicated through the website, app or another reasonable channel. The effective date at the top of this page identifies the current version.
21. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute will be handled by a court or lawful dispute-resolution forum with jurisdiction, subject to applicable consumer rights.
